Spectati End User License Agreement

This End User License Agreement governs your use of the Spectati applications, websites, updates, and related services that link to this agreement.

By downloading, installing, accessing, or using Spectati, you agree to this EULA. If you do not agree, do not use the software.

For any Spectati application obtained through the Apple App Store, this EULA is concluded between you and Spectati only, and not with Apple. Spectati, not Apple, is solely responsible for the application and its content. Nothing in this EULA conflicts with the Apple Media Services Terms and Conditions or their Usage Rules.

Subject to this EULA, Spectati grants you a limited, non-exclusive, non-transferable, revocable license to install and use the software for your personal or internal business use on devices you own or control.

For an application obtained through the Apple App Store, this license is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The application may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, or other sharing mechanisms permitted by Apple.

This license is granted, not sold. Spectati and its licensors retain all rights not expressly granted in this EULA.

Spectati may let you connect third-party media servers, playlists, metadata providers, subtitle providers, sync providers, and account services, including Plex, Jellyfin, IPTV, Xtream-compatible IPTV, SIMKL, TMDB, TVDB, OMDb, OpenSubtitles, and similar sources. You are responsible for the legality, accuracy, security, and availability of every source you connect.

Spectati does not provide television channels, movies, series, IPTV subscriptions, playlists, streams, or other media content. You may only stream, sync, cache, download, or otherwise access content through Spectati if you have all rights and permissions required for that content in your jurisdiction.

Provider credentials, server URLs, playlists, guide data, metadata, subtitle files, watch state, and playback availability are controlled by you and the third-party services you choose to use. Spectati is not responsible for third-party service terms, outages, account restrictions, rate limits, takedowns, content changes, metadata errors, or subtitle accuracy.

You may not use Spectati to violate law, infringe intellectual property rights, bypass access restrictions, interfere with the service, or distribute malware or harmful code.

You may not copy, rent, lease, sublicense, sell, or redistribute Spectati except as expressly allowed by Spectati in writing, by an applicable third-party or open-source license, or by applicable law.

Paid features, free trials, and auto-renewing subscriptions may be offered through Apple StoreKit or other authorized marketplaces. Billing, renewal notices, cancellation, refund eligibility, grace periods, price changes, and family sharing are handled under the terms and controls of the marketplace through which you purchased the subscription, except where Spectati states otherwise.

A Spectati subscription licenses access to Spectati app features. It does not include, grant rights to, or pay for third-party media content, provider accounts, IPTV services, metadata services, subtitle services, internet access, storage, or hardware.

Spectati may release updates, patches, security fixes, or new features, and may change or discontinue features, integrations, or compatibility at any time.

Some functionality may stop working if third-party providers change their APIs, authentication requirements, file formats, or service terms.

Spectati is solely responsible for providing maintenance and support for the application as specified in this EULA or as required by applicable law.

For applications obtained through the Apple App Store, you and Spectati acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for the application.

Spectati includes or depends on third-party software components that are licensed under separate terms. Those separate license terms apply to the relevant components and are not restricted by this EULA.

Nothing in this EULA limits any rights you may have under an applicable open-source license. Where required, Spectati will provide the notices, attributions, and source-availability information for the relevant third-party components with the distributed build or download page for that build.

Spectati includes libraries from the FFmpeg project in all distributed builds. FFmpeg is licensed under the GNU Lesser General Public License version 2.1 (LGPLv2.1).

Spectati does not claim ownership of FFmpeg. The applicable FFmpeg copyright holders are identified in the FFmpeg source code and accompanying notices.

Because every distributed build of Spectati includes FFmpeg or another LGPL-covered library, any terms in this EULA that restrict copying, modification, reverse engineering, relinking, debugging, or replacement of those libraries do not apply where such activity is permitted by the LGPL or other applicable law.

Spectati does not modify FFmpeg. For every distributed Spectati build, the corresponding FFmpeg source code is the official unmodified FFmpeg release, available at ffmpeg.org/download.html.

Spectati is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed under this EULA.

If an application obtained through the Apple App Store fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the application. Spectati is solely responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

Spectati, not Apple, is responsible for addressing any claim by you or a third party relating to the application or your possession or use of it. This includes product liability claims, claims that the application fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Nothing in this EULA limits Spectati's liability beyond what is permitted by applicable law.

Except for third-party materials and your own content, Spectati and its licensors own the software, branding, design, text, graphics, and other materials made available through Spectati.

If a third party claims that an application obtained through the Apple App Store, or your possession and use of it, infringes that third party's intellectual property rights, Spectati, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.

You must comply with all applicable third-party terms when using Spectati. This includes the terms of connected media, IPTV, metadata, subtitle, account, internet, wireless-data, cloud, device-platform, and marketplace providers.

Your use of a third-party service through Spectati does not create a relationship between Spectati and that third party or make Spectati responsible for the third party's service.

You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.

You must comply with all applicable export-control, sanctions, and other laws when downloading, accessing, or using Spectati.

Spectati is provided on an as-is and as-available basis to the maximum extent permitted by law. Spectati disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Spectati does not warrant that the software will be uninterrupted, secure, error-free, or compatible with every device, provider, playlist, codec, metadata source, subtitle source, server, network, or media library.

Recommendations, artwork, descriptions, ratings, subtitles, intro detection, channel guides, watch-state sync, downloads, and playback features may be incomplete, delayed, unavailable, or inaccurate because they depend on your devices, connected providers, network conditions, and third-party data sources.

To the maximum extent permitted by law, Spectati and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption arising from or related to your use of Spectati.

To the maximum extent permitted by law, the total aggregate liability of Spectati for all claims arising out of or relating to Spectati will not exceed the greater of the amount you paid to Spectati for the software in the 12 months before the event giving rise to the claim or USD 50.

This EULA remains in effect until terminated. It terminates automatically if you fail to comply with it.

Upon termination, you must stop using Spectati and delete all copies of the software in your possession or control, except for third-party components licensed to you under separate terms that survive termination under their own licenses.

For an application obtained through the Apple App Store, you and Spectati acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. When you accept this EULA, Apple has the right, and is deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
